Sussex Police: Officer Allegedly Withheld Evidence & Asked For Cover-Up

An officer with Sussex Police is due to face a misconduct hearing today, at which it will be alleged they compromised a criminal investigation by breaking standards of professional behaviour.

For what Police claim are legally justified reasons, they won't name the officer concerned at this point in proceedings.

The claims concern alleged failures to disclose evidence, and a further allegation that the officer asked a financial investigator to stay quiet about the existence of some of the evidence.

Sussex Police added that, if the accusations are proven, they amount to gross misconduct.

In full, it's alleged that the officer:

  1. Failed to include all of the CCTV footage provided on disclosure schedules in compliance with the Criminal Procedure And Investigations Act 1996.  Such behaviour amounts to a breach of the following Standards of Professional Behaviour: Duties and Responsibilities, & Discreditable Conduct
     
  2. During an investigation, they failed to disclose three discs containing mobile phone data in compliance with the CPIA 1996, compromising the criminal investigation. Such behaviour amounts to a breach of the following Standards of Professional Behaviour: Duties and Responsibilities, & Discreditable Conduct
     
  3. On 1 May 2019, they emailed a Financial Investigator asking her not to mention that the CCTV existed. Such behaviour amounts to a breach of the following Standards of Professional Behaviour: Honesty and Integrity, & Discreditable Conduct.

Police have not indicated how long the hearing is expected to take.

According to the service, the sanctions possible if gross misconduct is proven can be chosen from:

  • Dismissal without notice
  • Dismissal with notice
  • Final Written Warning
  • Written warning
  • Management advice
